Program Parameters and Legal Disclaimers
All funds raised around the 2007 CN Canadian Women’s Open through the CN Miracle Match program will directly benefit the Stollery Children’s Hospital Foundation. Outlined below are the various streams and phases of giving and CN’s matching commitment applicable to each. All terms and conditions reflect the governing parameters of CN’s corporate donation policy and remain at the sole discretion of CN and its affiliates.
A. Early Bird: June 14 - July 15, 2007
a. CN matches 25% of all personal and corporate donations under $1,000
b. CN matches up to $5,000 per personal or corporate donation.
c. For a single donation over $1,000, CN will match 100% of the donation and also provide 2 weekly passes to the 2007 CN Canadian Women’s Open and post the individual or organization’s name on an Early Bird donor board from August 13 – August 19, 2007.
d. To qualify for CN matching, donations need to be processed online at CNMiracleMatch.ca
e. Personal donors will receive an official tax receipt from the Stollery Children’s Hospital Foundation within 90 days of their donation. Corporate donors will not received an official tax receipt for their donation.
B. Summer Ramp Up: July 16 – Aug 12, 2007
a. CN matches 25% of all Personal and Corporate Donations up to $5,000 per individual or organization.
b. To qualify for CN matching, donations need to be processed online at CNMiracleMatch.ca
c. Personal donors will receive an official tax receipt from the Stollery Children’s Hospital Foundation within 90 days of their donation. Corporate donors will not received an official tax receipt for their donation.
C. Tournament Week: August 13 – August 19, 2007
a. CN matches 100% of all Personal and Corporate Donations up to $5,000 per individual or organization.
b. To qualify for CN matching, donations need to be processed online at CNMiracleMatch.ca or made onsite at the 2007 CN Canadian Women’s Open at the Royal Mayfair Golf Club
c. Personal donors will receive an official tax receipt from the Stollery Children’s Hospital Foundation within 90 days of their donation. Corporate donors will not received an official tax receipt for their donation.
Online Auctions
A. Winners of online auction items will not receive a tax receipt from the Stollery Children’s Hospital Foundation, however proceeds will be directed to Stollery Childrens Hospital
B. The winning Bid amount for online auctions will be matched by CN at 25% and will be included in the overall cumulative fundraising total
Support Maximums
A. CN’s contribution per single donation is set at a maximum of $5,000
B. The CN Miracle Match goal of $500,000 includes:
a. All fund raised through personal and corporate donations to the CN Miracle Match program
b. Donation matching and incremental donations by CN
c. 50% of the net proceeds from the 2007 CN Canadian Women’s Open
C. CN’s total contribution to the CN Miracle Match is currently set at a maximum of $250,000 Cdn, however CN reserves the right to modify this projection at is sole and utter discretion at any time.
Legal Terms and Conditions
General Terms
Canadian National Railway Company, including its subsidiaries (collectively "CN"), makes available it’s CN Miracle Match program, subject to the following terms, conditions and notices. By participating in this program, you are deemed to agree to without modification the terms, conditions and notices contained herein. CN may change such terms, conditions and notices from time to time, at its sole discretion and without prior notice, and you agree to comply with and be bound by such terms and conditions as they may be modified, changed or amended.
By participating in this program, you agree that disputes arising out of or relating to the contents or use of this program are to be governed by the laws of the Province of Ontario and any applicable federal law of Canada and you consent to the exclusive jurisdiction of courts sitting in the Province of Ontario in all disputes arising out of or relating to the use of this program. You agree that the venue of any action brought against CN shall be within the Ontario or Canadian federal court system. You agree that all such disputes shall be tried by the court according to the laws of Ontario and Canada applicable therein without reference to conflict of laws principles and hereby waive any right to trial by jury.
You agree that no joint venture, partnership, employment, or agency relationship exists between you and CN as a result of participation in this program.
If any part of this agreement is determined to be invalid or unenforceable pursuant to applicable law including, but not limited to, the warranty disclaimers and liability limitations set forth below, then the invalid or unenforceable provision will be deemed superseded by a valid, enforceable provision that most closely matches the intent of the original provision and the remainder of the agreement shall continue in effect.
This agreement constitutes the entire agreement between you and CN with respect to this program and it supersedes all prior or contemporaneous communications and proposals, whether electronic, oral or written, between you and CN with respect to this program. A printed version of this agreement and of any notice given in electronic form shall be admissible in judicial or administrative proceedings based upon or relating to this agreement to the same extent and subject to the same conditions as other business documents and records originally generated and maintained in printed form.
Copyright and Trademark
The information, graphics, and other material from this program are protected under the copyright laws of Canada and of other countries. Certain names, words, titles, phrases, logos, icons, graphics or designs in the pages of this program may constitute trade-names, trade-marks or service marks of CN or its subsidiaries, or the use of which may have been licensed to them.
Any unauthorized republication or other copying or modification of material from the program, including trade-marks, trade-names and service marks, may violate federal, common or civil law trade-mark law and copyright law, is prohibited and may result in legal action.
If you are authorized to use material of the program, CN reserves the right to require you to delete, destroy or otherwise remove any content that is used in a manner that in CN's opinion is contrary to this agreement. You agree that any person to whom you supply the content, directly or indirectly, will be advised of the terms of this Agreement, and that each such person is bound by these terms.
