Program Parameters and Legal Disclaimers
All funds raised through CN Miracle Match donation steams will be directed to the Saint-Justine UHC Foundation and The Montreal Children’s Hospital Foundation.
Outlined below is CN’s matching commitment applicable to the 2011 CN Miracle Match program. All terms and conditions reflect the governing parameters of CN’s corporate donation policy and remain at the sole discretion of CN and its affiliates.
Parameters
• Donation Period: May 12th , 2011 at 9:00am EST to August 28th, 2011 at 5:00pm EST
• CN matches 100% of all personal and corporate donations up to $5,000 per donation. Single donations over $5,000 may be matched by CN but must receive approval prior to the donation, and will be reviewed on a case by case basis. The Saint-Justine UHC Foundation or The Montreal Children’s Hospital Foundation should be contacted for approvals
• Where separation is possible, donations can either be directed to The Saint-Justine UHC Foundation or The Montreal Children’s Hospital Foundation and tax receipts will be provided from those particular Foundations. Where donation separation is not possible, a tax receipt may be provided from one Foundation or the other, however, funds will be shared
• To qualify for CN matching, funds need to be raised through one of the following CN Miracle Match donation streams: - Donations made through CN Miracle Match online at cnmiraclematch.ca
- Donations made through CN Canadian Women’s Open online at cncanadianwomensopen.com or over the phone at 866.571.5742
- Donations made and identified as CN Miracle Match donations by the Saint-Justine UHC Foundation either online at www.fondation-sainte-justine.org, over the phone at 514 345-4710, through the mail or at the Foundation office
- Donations made and identified as CN Miracle Match donations by the Montreal Children’s Hospital Foundation either online at www. www.fondationduchildren.com.org, over the phone at 514-934-4846, through the mail or at the Foundation office
- Donations made onsite at the CN Canadian Women’s Open
- CN Miracle Match net proceeds raised through CN Canadian Women's Open ticket sales
- Proceeds raised through CN Miracle Match Wristband sales
- Funds raised from online auctions hosted on cnmiraclematch.ca
• Individual donors who contribute $20 or more towards the charity are eligible to receive an official tax receipt from the Saint-Justine UHC Foundation or The Montreal Children’s Hospital Foundation. However, you may request a receipt for donations of less than $20. Tax receipts will be issued at pre-match amounts. Tax receipts will be issued for Direct Donations. Tax receipts will not be issued for CN Miracle Match Wristbands and CN Canadian Women’s Open Ticket Purchases. Corporate donors will not receive an official tax receipt
• CN’s corporate contribution to the CN Miracle Match is currently set at a maximum of $700,000 CAD, however CN reserves the right to modify this projection at its discretion at any time
• Online Auctions:
- Winners of online auction items will not receive a tax receipt, however all proceeds will be directed to the beneficiary
- The winning bid amount for online auctions will be matched by CN at 100% and will be included in the overall cumulative fundraising total
• All funds are expressed in Canadian Dollars
The CN Miracle Match Fundraising Total Calculation will include:
• All funds raised through individual and corporate donations to the CN Miracle Match program including CN Miracle Match wristband purchases
• All funds raised through CN Canadian Women's Open Ticket sales
• All funds raised through CN Miracle Match auctions
• CN donation matching and incremental donations by CN
Legal Terms and Conditions
General Terms
Canadian National Railway Company, including its subsidiaries (collectively "CN"), makes available it’s CN Miracle Match program, subject to the following terms, conditions and notices. By participating in this program, you are deemed to agree to without modification the terms, conditions and notices contained herein. CN may change such terms, conditions and notices from time to time, at its sole discretion and without prior notice, and you agree to comply with and be bound by such terms and conditions as they may be modified, changed or amended.
By participating in this program, you agree that disputes arising out of or relating to the contents or use of this program are to be governed by the laws of the Province of Quebec and any applicable federal law of Canada and you consent to the exclusive jurisdiction of courts sitting in the Province of Quebec in all disputes arising out of or relating to the use of this program. You agree that the venue of any action brought against CN shall be within the Quebec or Canadian federal court system. You agree that all such disputes shall be tried by the court according to the laws of Quebec and Canada applicable therein without reference to conflict of laws principles and hereby waive any right to trial by jury.
You agree that no joint venture, partnership, employment, or agency relationship exists between you and CN as a result of participation in this program.
If any part of this agreement is determined to be invalid or unenforceable pursuant to applicable law including, but not limited to, the warranty disclaimers and liability limitations set forth below, then the invalid or unenforceable provision will be deemed superseded by a valid, enforceable provision that most closely matches the intent of the original provision and the remainder of the agreement shall continue in effect.
This agreement constitutes the entire agreement between you and CN with respect to this program and it supersedes all prior or contemporaneous communications and proposals, whether electronic, oral or written, between you and CN with respect to this program. A printed version of this agreement and of any notice given in electronic form shall be admissible in judicial or administrative proceedings based upon or relating to this agreement to the same extent and subject to the same conditions as other business documents and records originally generated and maintained in printed form.
Copyright and Trademark
The information, graphics, and other material from this program are protected under the copyright laws of Canada and of other countries. Certain names, words, titles, phrases, logos, icons, graphics or designs in the pages of this program may constitute trade-names, trade-marks or service marks of CN or its subsidiaries, or the use of which may have been licensed to them.
Any unauthorized republication or other copying or modification of material from the program, including trade-marks, trade-names and service marks, may violate federal, common or civil law trade-mark law and copyright law, is prohibited and may result in legal action.
If you are authorized to use material of the program, CN reserves the right to require you to delete, destroy or otherwise remove any content that is used in a manner that in CN's opinion is contrary to this agreement. You agree that any person to whom you supply the content, directly or indirectly, will be advised of the terms of this Agreement, and that each such person is bound by these terms.

Images of people or places through your connection with the program are either the property of, or used with permission by, CN. The use of these images by you, or anyone else authorized by you, is prohibited unless specifically permitted by these terms and conditions. Any unauthorized use of the images may violate copyright laws, trademark laws, the laws of privacy and publicity or other applicable laws.
